Government
exists to serve us!  Not for us to ignore them and allow them to push their commercial and political gains by voting against us.  Don't see this?  Ask the residents north of Blue Ridge or the Midland Dr. residents where the city tried to force the Dollar General Store on them against their will. How about the energy tower funding of 9/17/2013, two weeks after the mayor implied it would not be voted on until the new council took office in 2014?

Sounds just like our Midland City Council, does it not?  ERP is the "big spender" that they are trying to please by helping him build offensive tower downtown against our will.  This will feed some on the council and   It will also feed  the tax coffers for their spending  and not reduction of our property taxes (TIRZ Funding).

THE 2 CRITICAL ISSUES OF THE NEW AGREEMENT CALLED "TERM SHEET" ARE QUOTED BELOW.



1. HOW MANY TIRZ DISTRICTS ARE TO BE INVOLVED IN THIS PROJECT?
Item 3c, paragraph 4.

"Notwithstanding anything to the contrary above, if less than the existing 4 total TIRZ taxing jurisdictions are parties to such economic development agreement at any time, the City’s percentage contribution towards payment of the Development Incentive will ratably increase from 80% to make up such deficiency in the real estate tax contribution (but in no event shall such City share exceed 85%), and the repayment period specified in Section 3(c)(ii) above will be extended for a period of 5 full calendar years (but in no event longer than needed to reach the $50,000,000 repayment cap)."
I THOUGHT WE WERE TOLD 80%.  IF THE OTHER 3 TIRZ FUNDS DON'T JOIN IN WE NOW OWE DEVELOPER 85%?  WRITING MORALES ABOUT THIS TOO.


2.  DEVELOPER APPEARS TO WANT MIDLAND TO VOID ITS SOVEREIGN RIGHT OF PROTECTION TO ALLOW DEVELOPER TO SUE CITY SHOULD ANYTHING GO WRONG ! 
Item 4b.

Unrecognized Guid format."The City agrees to use its best efforts to support and obtain passage of a validation act in the 2015 Texas legislative session that includes a legislative waiver of the City’s sovereign or governmental immunity from suit with respect all City agreements with the Developer including the City’s funding and tax reimbursement obligations to Developer under this Term Sheet, as well as to any related obligations under the TIRZ economic development agreement. The City also agrees to use best efforts to cause other jurisdictions participating in TIRZ to support and obtain passage of a validation act in the 2015 Texas legislative session that includes legislative waivers of their respective sovereign or governmental immunity from suit for their funding and tax reimbursement obligations under the TIRZ economic development agreement."

IF THIS IS SUCH A GREAT PROJECT TO BE THE "ICON" OF MIDLAND AND TO CREATE A "VIBRANT" COMMUNITY....WHY DOES THE ENTITLED DEVELOPER ASK FOR THIS BEFORE THE PROJECT HAS EVEN BEGUN? 

WHY WOULD OUR CITY GOVERNMENT EVEN THINK ABOUT SIGNING SUCH AN AGREEMENT, WHICH THEY DID?

HOW MUCH INFLUENCE DOES THIS DEVELOPER HAVE OVER OUR GOVERNMENT?

THE MAIN ISSUES OF THE AMENDMENT PURCHASE SALE AGREEMENT ARE:
1) THAT THE DUE DILIGENCE PERIOD WAS EXTENDED TO 9/30/2014;  AND,
2) IN PARAGRAPH 5 IT SHOWS THAT THE DEVELOPER CAN START TEARING DOWN THE OLD COURTHOUSE BEFORE THE DEAL IS FINALIZED.

AFTER READING THESE PLUS ALL THE OTHER AGREEMENTS, DO YOU  SEE WHY WE DO NOT WANT OUR GOVERNMENT INVOLVED IN PUBLIC-PRIVATE PARTNERSHIPS?  WE HAVE NO CONTROL OVER THESE ISSUES WITH OUR GOVERNMENT AND CANNOT RUN THE DEVELOPER OUT OF OFFICE.

CONTENT

What are the issues of Midland?  Traffic, crime, a secret deal made by the city government for the Energy Tower, bad planning & zoning against citizens, and a city government that seems obsessed with commercialism and money but shows little interest in our quality-of-life.  This last issue alone is leading to a bloated government that is becoming too big for us to retain control of.  This has been a delightful place to live with endearing qualities.  With this much excessive change we are losing that and the city has planned more change in their Midland Smart Downtown Plan and Master Plan. 


Summary of What This Website is About
This article gives a synopsis of the issues and purposes of this website.  It is 1 page long.  In my opinion our community is a precious and unique place that you cannot find just anywhere.  It is critical that we protect what we love or it will be gone forever in a few years.  If our city government wants to do this for the "youth", then what effects will increased prostitution, drugs, gangs, and human trafficking have upon them?  What effects will a downtown urban center built on vanity and always known as an area of immorality have on the youth?  The detailed issues will be discussed in the Content items below.  This summary is designed to express why what we have in Midland is special and why we need to expose and take back control of our city government's agenda to change Midland into something that we have never been.

Midland Texas and the Ill Effects of Urban Living
This article ties together almost all of the issues we see here in Midland from our traffic and crime problems to the fact and proof that our city government is pushing for major change of Midland.  Why does our city government wish to sacrifice the endearing qualities of this unique and special town for commerce?  There are numerous urls for you to link to, to read the articles for yourself.  Not all of these articles are against urban living they simply point out the issues and some offer solutions; however, is it not better to prevent these negative effects on our community to begin with rather than creating them?





Conflicts of Interest
You will benefit from reading this because you will see that our city government is hiding the truth about their dealings with this tower and trying to keep us at bay so we do not oppose them.

This site has the pdf of all the emails sent to this effort requested under the first Freedom of Information Act (FOIA).  We have received another FOIA but have not had time to review the 1600+ pages.  It is unlikely that the pdf will fit into the memory of the site so we will have to pick the issues and summarize.  Some of these emails show that there are conflicts of interest for Wes Perry and Wendell "Scooter" Brown of Wexford Capital that is funding the Energy Tower. 


Contradictions?
This article will list another set of FOIA emails that give evidence that the comments we received from city leaders regarding the "Memo of Understanding" and other issues do not add up.



MRT States Some Agreement with What This Website Has Stated
The 12/30/2013 MRT wrote its own editorial regarding the Tower and its issues at the end of 2013.  These include the facts that the city has not offered a public forum to discuss the tower (evidence the city is hiding the deal and knows that we oppose it-my comment), that the city voted on the TIRZ and MDC funding to show that the "citizens" supported the tower to help ERP get tenants, this early vote diminished the issue from the November election, and will Morales be any different from the previous administration on this deal.  I have simply posted the short article for your review at this link to see the evidence.


Why Energy Tower is a bad idea
There are 3 major reasons why the Energy Tower is bad for Midland: 1) It is driven by a public-private collaboration between our city government and ERP over which there are many concerns by the people and a number of issues from city leaders that show they are trying to hide the details; 2) there will be horrible traffic issues created not only downtown but on all the arteries feeding downtown, which will fill the areas around many neighborhoods with traffic; 3)  The tower will likely bring much cultural change to downtown that is contrary to our Midland way-of-life, which is known as social engineering and the "leaders" even admit it.  However there is a deeper issue involved.  The Downtown Revitalization pushed by our city government under their Midland Smart Downtown Plan.

Midland Smart Downtown Plan

The Midland Smart Downtown Plan, also available at the URL above, contains the "Big Bang Scenario" (Pg. 36) that lists a future project exactly like this proposed tower downtown and exactly at Centennial Plaza.  Note that the city has created a new website and the url for the Downtown Plan and Master Plans have changed.

The Master Plan is very much about promoting commerce in Midland and making Midland a cosmopolitan area with little that I have found about preserving our traditions and quality-of-life.  It specifically endorses increased downtown population and living (Objective D-1.3). 

An interesting contradiction is in their mission statement found on pg. 86, "Midland will be the region's premier community for family's and business.  Then the very first goal that they promote is Objective A-1 (pg. 86) "Continue proactive planning and development related to the La Entrada corridor".  This is the NAFTA road on IH-20.  The Sheriff has stated that these NAFTA roads will be a real problem for gangs, drugs, and human trafficking as Midland grows.  Why does our city promote a North American Union highway that will certainly cause more crime in Midland, immediately after starting that "families" are one of their 2 key issues?  How can families be better with this level of crime?  What sounds more important to them:  families or business?




Create the Problem that Leads to the Desired Solution? (Hegelian Dialectic)
Are the problems we see in our world today purposely done in order to create a solution that takes away more of our rights?  Are we having this same problem here in Midland since our city government has failed to solve our growth problems after 5-6 years in spite of their aiding the generation of these problems by promoting Midland as a commodity?

One major issue with the Energy Tower is the fact that it is a public-private collaboration aka public-private partnership (P3).  When government is making deals with a special interest group and their are millions of dollars involved, who will they vote for:  Us or their business partner?

Abusive Capitalism
Capitalism can be corrupted and abused like anything else in the world.  Do not take someone's comment about how a project is "capitalism" without looking into it.  Government partnerships with business are not free-market capitalism.  The energy tower is just that and appears to be a move toward monopolistic control over our downtown area.





ZONING ISSUES

This portion of webpage discusses how the city government has forced zoning issues on its constituents against their will in order to appeal to developers.  Do we have a housing shortage or a population crisis?  If you want 10's of thousands more customers for your retail business or employees you probably think of it as a housing shortage.  If you love the endearing qualities of the Midland that we have loved, you likely see that developers and business is being served and not the average Midlander.  It is important to understand that this much change for vanity and greed are NOT endearing qualities or intrinsic values.  Growing one's business is great but what gives the city government the right to take advantage of a boom with approximately 23 million Americans unemployed during a drought to transform our city into something to attract as many as possible?  What gives the city the right to change Midland into a 24/7 business area with constant stress and traffic and crime against the will of the core of Midland and against the traditions of Midland living?
